Massachusetts Construction Site Worker Falls into Open Manhole——$500k Settlement.

A Massachusetts union laborer, 44, was recently working on a roadway and bridge construction project for a subcontractor after dark.  He was carrying iron grates to install underneath the bridge.

While carrying the grates some 40 feet to the bridge, he fell into an open, uncovered manhole.  As he was falling, he injured his right arm and shoulder, requiring him to undergo two shoulder surgeries.  Luckily, he was eventually able to return to work.

The laborer sued the general contractor for failing to maintain a safe worksite and failing to provide adequate lighting for its employees.  The general contractor denied liability, arguing that the open manhole was an open and obvious hazard.

The parties eventually reached a settlement whereby the laborer received $500,000.
