Crossing Guard Sacrifices Her Own Life To Save Children From Drunk Driver.

65-year-old Bertha Gawens was a crossing guard in the small northern New York town of Irondequoit back in 1982. She loved her job and felt a sense of satisfaction and reward as she safely brought young children from one side of a busy intersection to the other. One chilly April afternoon, however, a drunk driver sped past the intersection stop-sign and was only moments from striking a group of second grade students. Without hesitation, Bertha threw herself in front of the vehicle, putting herself between the brown Mercury and two young girls. The force threw her over the vehicle and onto the ground, leaving her in a coma that lasted more than 5 years. Unfortunately, Bertha never woke up from that coma. The two young girls, aged 6 and 7 at the time, survived with minor injuries because of the brave actions by Bertha that day.

More than 30 years after the car accident, the local paper celebrated the amazing story of the crossing guard who sacrificed her own life to save the lives of two young girls. They are now in their late 30’s and living happy lives with children of their own. The drunk driver who struck Bertha had allegedly been drinking at a local bar that morning and ultimately pleaded guilty to second-degree assault. He only served one year in jail.

Drunk drivers are a serious hazard on the road.  They can cause severe injuries to themselves, pedestrians, or other drivers, or even be the cause of a wrongful death.  A drunk driver can be held criminally accountable for the injuries they cause, in addition to paying monetary damages to their victims. Even a minor car collision can result in serious injury or even death.  While the average driver is sometimes at risk, intoxicated drivers pose a tremendous safety risk to not only themselves, but every other person on the road.

If you or a loved one has been the victim of a drunk driver, you may be entitled to substantial financial compensation. Call our expert Massachusetts drunk driving lawyers at (617) 787-3700, 24 hours a day, 7 days a week, or email us at

Massachusetts Nursing Home Worker Arrested After Allegations Of Assaulting Elderly Patient.

It is a sad reality, but far too often, nursing homes are places of abuse and neglect.  These facilities are entrusted with the comfort and care of our loved ones who require constant attention and cannot care for themselves.  Unfortunately, this also makes them vulnerable.  Nursing home employees sometimes take advantage of that vulnerability and systematically and repeatedly abuse their patients. Abused nursing home patients too frequently have been physically and mentally harmed, robbed and humiliated.  When that happens, it is essential that a family member consult with a Boston nursing home abuse lawyer to file a personal injury lawsuit against the attacker and their employer to hold the negligent parties responsible.

Thirty-two-year-old Ashay Peppers recently faced a grand jury after allegations arose that she assaulted one of the patients in her care. Peppers is a worker for the Oakwood Village Nursing home in Springfield, Massachusetts.  She is accused of kicking a 95-year-old female patient, and was arrested after eye witnesses reported the incident to the police. According to, the patient suffered a large hematoma as a result of being struck.  Peppers faces multiple charges, and if convicted, could face several years in prison.

While a criminal trial and penalty may prevent Peppers from abusing any patients in the future, it does little to compensate her victim or the victim’s family.  Often, the only way for a victim or their family to recover direct compensation is through a successful personal injury lawsuit. Have you or a family member been a victim of nursing home abuse? If so, you may be entitled to substantial compensation for your physical injuries, as well as any emotional trauma and financial hardship caused by the incident.  Call our Massachusetts nursing home abuse attorney specialists 24/7 at 617-787-3700, or email us at for your free and confidential consultation.

Japanese Michelin Star Restaurant Temporarily Shut Down After Alleged Food Poisoning.

Many experts believe that nearly half of all food poisoning incidents go unreported. In addition, it is estimated that nearly one in four people suffer from food poisoning every year in the United States. This number is disturbingly high, especially when you consider that some food poisoning incidents result in serious injury and even wrongful death.  If you experience the symptoms of food poising after eating out, you may want to contact a food poisoning attorney specialist to learn about your legal options.

While many people assume that unclean, cheap restaurants are the only source of food poisoning, even some of the world’s most prestigious eateries can serve improperly cooked or contaminated food.  This was recently the case with a Michelin star restaurant in Tokyo, Japan that reportedly had fourteen customers complain of food poisoning.

For over a century, Michelin has been reporting on and rating the world’s top restaurants and giving them a ranking of zero to three stars. It is difficult to get even one Michelin star, and a two or three star rating is nearly impossible.  In the United States, for example, despite having literally tens of thousands of restaurants, bars, hotels and other eateries, only fourteen have received more than one Michelin star.

A one-star restaurant in Tokyo, Japan, known for its squid, jelly with sea urchin, pumpkin cooked with fish, eel and sweets and quiet Japanese-style rooms, voluntarily shut down during an investigation after multiple patrons reported feeling ill after eating.  The exact menu and what was served is still being looked into, but apparently even a highly decorated restaurant sometimes may serve food that causes its patrons to become ill.

If you or a family member have experienced food poisoning, call our Massachusetts food poisoning attorney experts at (617) 787-3700 to learn about your legal options. If it happened recently, you may be able to bring a civil lawsuit against those who served you the tainted food. You may be able to recover money damages for your pain and suffering, medical expenses, future bills and lost wages.  Call us today!
